These Terms and Conditions (“Terms”) govern the provision of services by Yoga Healers Organization (referred to as “YHO”), with its seat in Delhi, India. By engaging in any of the services provided by YHO, including but not limited to yoga, counselling, trekking, and camping, you agree to adhere to these Terms. Please note that by accessing, viewing, using, or downloading materials from the Website, you agree to be legally bound by all of the terms, conditions and notices contained or referenced in this Agreement.

Eligibility
You must be at least 18 years old to use our services. By using our services, you represent and warrant that you are at least 18. To use our services as a minor, you must have close supervision from a parent or guardian.

Certification
The Certificate shall only be awarded once you have taken all classes, completed the course and paid all the dues. Only once you are awarded your certificate, will you shall be registered with YHO. There will be separate charges for registering with YHO due to the cost incurred by the management.

YHO shall not be responsible for its certified and registered students’s conduct and professionalism. Our certification only acknowledges that a student has completed the course with which the respective student is certified.

Health And Safety
Prior to participating in any physical activity such as yoga, trekking or camping, you must ensure that you are physically fit and have no medical conditions that would prevent you from safely engaging in such activities.

YHO advises all participants to consult with a medical professional before engaging in any physical activity or counselling provided by YHO or its affiliates.

The participant/user shall have to bear responsibility for their safety, health and injury while acting with negligence or contrary to the instructions of YHO. In every circumstance, every participant is expected to act prudently, and in no such case where the user is at fault, YHO shall be liable.

Cancellations & Refunds
YHO maintains a strict no-refund policy for most services. Refunds are only considered for specific services if a cancellation request is received at least 14 days before the scheduled service date for a monthly package and a month before the scheduled date for any plan or package more than one month. For eligible refunds, a deduction of 18% of the total service fee will apply to cover the administrative and scheduling costs incurred by YHO. Cancellation requests must be submitted in writing to the YHO customer service team, and refunds, minus the applicable charges, will be processed within 30 days of cancellation approval.

If a client has underpaid for a package or service, they must contact the YHO team to settle the outstanding amount. Alternatively, they may seek a refund, which will be processed according to YHO’s policy, including the deduction of applicable charges. Services not explicitly stated as eligible for a refund are non-refundable under any circumstances. YHO reserves the right to update or change this policy at any time.

Defamation
If any individual post a message that (i) impersonates any person or entity; (ii) falsely states or otherwise misrepresents your affiliation with a person or entity; or (iii) that includes personal or identifying information about another person without that person’s explicit consent, then the person agrees to pay YHO five hundred dollars ($ 500) for each such message. This provision does not apply to messages that are lawful non-deceptive parodies of public figures.

Website Security
You are prohibited from violating or attempting to violate, the security of this Website. Any such violations may result in criminal and/or civil penalties against you. YHO shall investigate any alleged or suspected violations and if a criminal violation is suspected, YHO will cooperate with law enforcement agencies in their investigations.

Third-Party Content
YHO may email or provide coupons, offers, and other specials from third parties (collectively “Promotions”). YHO is not responsible for the redemption, errors, omissions, or expiration of Promotions. All Promotions featured as a part of the Service are subject to change without notice and YHO have no control over their legality or the ability of any merchant to complete the Promotion (including, the sale in accordance with the offer).

Intellectual Property Rights

Ownership
The Yoga Healers Organization (YHO) website and all of its original content, features, and functionality are and will remain the exclusive property of YHO and its licensors. This includes but is not limited to text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, and software.

Use of Content
Users are granted a limited, non-exclusive, non-transferable license to access and use the YHO website for personal, non-commercial purposes. Any other use of the website content, including but not limited to the reproduction, distribution, modification, display, or transmission of the content of this site, is strictly prohibited unless authorized by YHO in writing.

Trademarks
All trademarks, service marks, logos, and trade names displayed on the YHO website are proprietary to YHO or their respective owners. Unauthorized use of any YHO trademark, service mark, logo, or trade name is prohibited.

User-Generated Content
By submitting any content (including but not limited to comments, feedback, suggestions, ideas, and other submissions) to YHO through the website, users grant YHO a worldwide, perpetual, irrevocable, royalty-free, non-exclusive, and fully sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any media. Users represent and warrant that they own or otherwise control all of the rights to the content that they submit; that the content is accurate; that use of the content submitted does not violate this policy and will not cause injury to any person or entity; and that the user will indemnify YHO for all claims resulting from content supplied by the user.

YHO respects the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide YHO with the following information:

YHO reviews some but not all postings and reserves the right to remove any postings deemed inappropriate or offensive. This includes hate speech, discriminatory remarks, spam, intellectual property infringements, misinformation, and personal attacks. By posting content on YHO’s Social Media Pages, users grant YHO a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, adapt, publish, and display such content, while representing that they own or control all rights to the content. YHO encourages positive engagement and interaction but is not responsible for user-generated content and does not endorse any opinions expressed by users. Violations of these guidelines can be reported through the platform’s reporting mechanisms or directly to YHO.

Limitation of Liability:
In no event, including negligence, shall YHO, its directors, officers, or agents be liable for any direct, indirect, special, incidental, consequential, exemplary, or punitive damages arising from the use of this website, its content, or services, including lost business or lost end-users.

Indemnity
You agree to indemnify, defend and hold YHO and its directors, officers, employees, agents and contractors harmless from and against any and all claims, damages, losses, costs (including without limitation reasonable attorneys’ fees) or other expenses that arise directly or indirectly out of or from (i) your breach of any provision of this term and conditions and other Agreements that may be done with you and YHO; (ii) your activities in connection with this Website; or (iii) unsolicited information you provide to YHO through the Website.

Force Majure
YHO shall not be held responsible or liable for any failure or delay in the performance of its obligations due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, strikes, lockouts, labor disputes, fire, flood, earthquake, pandemics, or any other event that qualifies as a force majeure event. During such events, YHO’s obligations shall be suspended and shall resume once the force majeure event ceases. YHO will make reasonable efforts to inform its members and stakeholders of the occurrence of a force majeure event and its potential impact on its operations.

Termination
YHO reserves the right to suspend or terminate a user’s access to the website and services with or without notice for various reasons, including breaches of these Terms and Conditions or suspicion of illegal or fraudulent activity.

Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India, with the exclusive jurisdiction of the courts in Delhi.

Waiver
No provision of this Agreement shall be deemed waived, and no breach excused, unless such waiver or consent is in writing and signed by YHO. A waiver of one breach does not constitute consent to or an excuse for any.
